Writ of Habeas Corpus - Habeas corpus is a recourse in law through which a person can report an unlawful detention or imprisonment to a court and request that the court order the custodian of the person, usually a prison official, to bring the prisoner to court, to determine whether the detention is lawful.

NIST releases 4th version of security control catalog SP 800-53

The National Institute of Standards and Technology released April 30 a revised version of its security control catalog for federal systems, SP 800-53.NIST-Logo_5 The revision (.pdf), the fourth version of the security controls catalog, also includes for the first time an appendix of privacy controls. Changes to the security controls include a new emphasis on secure software development in an effort to shift security away from the focus of the past few years, during which it’s targeted matters such as configuration management or continuous monitoring.

Unfair Insurance Practices Act Can Give Rise To Private Cause Of Action Under UCL

The California Court of Appeal recently addressed the question of whether a violation of the Unfair Insurance Practices Act can give rise to a civil cause of action under the Unfair Competition Law (“UCL”). The court answered the question in the affirmative. In Zhang v. Superior Court, 178 Cal. App. 4th 1081 (2009), Plaintiff Zhang sued California Capital Insurance Company (“California Capital”) for breach of contract and bad faith arising out of the handling of her claim for damages to her commercial premises due to fire. In addition, Zhang alleged a cause of action under the UCL and for “unfair, deceptive, untrue, and/or misleading advertising.” California Capital demurred to Zhang’s third cause of action by arguing that the plaintiff could not state a private cause of action under the UCL due to the decision in Moradi-Shalal v. Fireman’s Fund Ins. Companies, 46 Cal.3d 287 (1988). The trial court agreed by sustaining the demurrer and Zhang appealed. On appeal, the court explain

Federal Rule of Evidence 702 governs the admissibility of expert testimony and permits a qualified expert to present testimony that “will assist the trier of fact” in understanding the evidence or in determining a factual issue, so long as “(1) the testimony is based upon sufficient facts or data, (2) the testimony is the product of reliable principles and methods, and (3) the witness has applied the principles and methods reliably to the facts of the case.” Fed.R.Evid. 702. Under Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579 (1993), the trial judge bears the responsibility of “gatekeeper” to ensure “that an expert’s testimony both rests on a reliable foundation and is relevant to the task at hand.” Daubert, 509 U.S. at 597, 113 S.Ct. 2786. The court is also responsible for determining whether the specialized knowledge or testimony of the expert is based on the application of reliable theories or techniques. HIPAA Omnibus Final Rule Released

This afternoon, HHS released the attached omnibus final rule modifying the HIPAA Privacy, Security, Enforcement, and Breach Notification Rules as required the Health Information Technology Economic and Clinical Health (HITECH) Act and the Genetic Information Nondiscrimination Act (GINA). Notably, the final rule makes business associates of covered entities directly liable for certain HIPAA Privacy and Security rule requirements; expands individuals’ right to receive electronic copies of their health information; incorporates an increased tiered and civil money penalty structure as provided by the HITECH Act; changes to the “harm” definition included in the HIPAA Breach Notification interim final rule; and modifies the HIPAA Privacy Rule as required by GINA.

Later today the White House will release its long-awaited privacy report entitled, “Consumer Data Privacy in a Used with Permission from FreeDigitalPhotos.netNetworked World: A Framework for Protecting Privacy and Promoting Innovation in the Global Digital Economy.” The report is the follow-up to the Commerce Department’s Internet Policy Task Force Green Paper entitled: “Commercial Data Privacy and Innovation in the Internet Economy: A Dynamic Policy Framework,” which was issued in December 2010.
